Concept of OSH, Duty of care, Functions of DOSH, NIOSH, SOCSO
Ok. Update for recently. Kejap lagi akan ada quiz OSH dan in order to help me answering those questions.. Let me share with you guys basic about OSH. ( well, cara baru aku utk mengingat nota sbelum jwb quiz,hehe)
Concept of OSH
- it is responsibility to ensure the safety and health of the work place is on those who create the risk and those who work with the risk. this include:
- self regulation
- consultation
- cooperation and workers participation
Duty of care
- The employer is still liable for duty of care even he has competent person under his care.
- injury on:
- each individual worker
- other workers due to mistakes or neglegence of workers or agents appointed to do the job. (vicarious liability)
- BUT, the employer will not responsible if the worker in his own accord such as horseplay while at work.
- NEGLIGENCE:
- there is the duty of care of one party onto another party.
- the violation resulted in damage/injury.
IMPORTANT SECTIONS
PART IV (Section 15-19)
Section 15- As far as practicable. (duties of employers and self employed person)
- ensure the safety, health and welfare of all workers while at work.
- includes : make arrangement maintenance, provisions of information, instructions,training and supervision.
- maintenance- improve /upgrade works
- safe system at work- safe premise and plant, adequate lighting.
- safety and health arrangements- provisions for PPE ( personal protective equipment) and tools.
Sections 16
- formulate written safety and health policy.
Section 17
- conduct work w/out endangering others.
- provide info to others in biz operation
Section 18
- the domestic premise to ensure the workplace is free from risk for both workers or others.
FUNCTIONS OF DOSH, NIOSH, and SOCSO
DOSH
- Reserch
- promotes OSH
- provides consultations and guidance.
- as secretariat for the National Council for Occupational Safety and Health.
NIOSH
- Teaching
- Consulting
- Reserch
SOCSO
- Giving social security protection in certain issues that are related.
